These Terms of Sale govern the sale of products and services marketed under the “Rails App” brand.
These Terms of Sale (“Terms”) define the rights and obligations of the parties in connection with the sale of software products and services marketed under the “Rails App” brand by BIG DG.
Any purchase made through the Rails App website implies full and unconditional acceptance of these Terms by the Client, who acknowledges having read them prior to placing an Order.
These Terms, together with the Order summary, constitute the entire agreement between the Company and the Client.

The Company owns and operates the “Rails App” brand and the website https://rails-app.com.
These Terms apply to all sales of Rails App Products and Services worldwide, subject to mandatory consumer protection laws applicable in the Client’s country of residence.
They govern ordering, payment, delivery, access conditions, refunds, intellectual property, and liability.
Before placing an Order, the Client has access to all essential information, including product descriptions, prices, payment terms, access conditions, and refund limitations.
By validating an Order, the Client confirms that they have received all necessary information and made their purchase decision knowingly.
Rails App provides digital software products designed for Ruby on Rails applications, including but not limited to visual page builders, tools, and related features.
Product descriptions are provided as accurately as possible. Visuals and examples are for illustrative purposes only and are non-contractual.
The Company reserves the right to update or improve Products, provided such changes do not materially reduce their core functionality.
Unless otherwise stated on the sales page, access to Rails App Products is granted for an unlimited duration following purchase, subject to compliance with these Terms.
Access to certain Products requires the creation of an account. The Client is responsible for maintaining the confidentiality of their Credentials and for all activity conducted under their account.
Credentials are strictly personal and non-transferable.
The Client selects the desired Product on the Site and validates the Order after reviewing the summary and accepting these Terms.
Order validation and payment confirmation constitute the formation of a binding sales contract.
Prices are displayed in USD unless otherwise stated. All prices are inclusive of applicable taxes unless specified.
The Company reserves the right to modify prices at any time, without affecting Orders already placed.
Payment is due immediately upon Order validation using the payment methods available on the Site.
In the case of installment or deferred payment options, the full price remains due.
Rails App Products are delivered digitally. Delivery consists of granting access to the software, platform, or downloadable resources after payment confirmation.
No physical shipment is involved unless explicitly stated.
In accordance with applicable consumer protection laws and Paddle's Buyer Terms, Clients qualifying as Consumers benefit from a 14-day right of withdrawal, starting from the day after the completion of the Order, without having to provide any reason.
To exercise this right, the Client must notify the Company within the applicable period by contacting: [email protected]
If the Client validly exercises the right of withdrawal, all payments received will be refunded without undue delay and no later than 14 days after receipt of the withdrawal request.
Refunds will be issued using the same payment method used for the original transaction, unless otherwise agreed.
Rails App Products are digital products delivered electronically and generally made available immediately after purchase.

Some Products may include access to private communities or discussion spaces. Clients agree to behave respectfully and lawfully.
The Company reserves the right to suspend or revoke access in case of misuse or violation of these Terms.
All content, software, source code, documentation, trademarks, logos, and materials provided under the Rails App brand are protected by intellectual property laws.
No ownership rights are transferred to the Client beyond a personal, non-exclusive license to use the Product.
Personal data is collected and processed in accordance with applicable data protection laws and the Privacy Policy available on the Site.
Clients have rights of access, rectification, and deletion as provided by law.
Rails App Products are provided “as is” and for professional use.
The Company does not guarantee specific results. Its liability is limited, in all cases, to the amount paid by the Client for the relevant Product.
The Company shall not be held liable for failure or delay in performance due to events beyond its reasonable control, including force majeure events.
With prior consent, the Company may use the Client’s name or logo as a reference for marketing purposes. Such consent may be withdrawn at any time in writing.
The Company reserves the right to modify these Terms at any time.
The version applicable to an Order is the one in force at the time of Order validation.
These Terms are governed by Tunisian law.
In the event of a dispute, the parties shall seek an amicable resolution before initiating legal proceedings. Failing that, the courts within the jurisdiction of the Company’s registered office shall have exclusive jurisdiction, subject to mandatory consumer protection rules.
